In December of last year, APAOC closed and PIASC proposed to take over the show and continue APAOC’s legacy of success with the help of former president, Julie Ester, and Paper Show Advisor, Bradley Keil.

CALIFORNIA ANTI-HARASSMENT AND ANTI-DISCRIMINATION POLICIES CHANGES COMING APRIL 1, 2016

Come April 1, 2016, California employers must comply with several new regulations in the workplace. Employers will need to be pro-active and work quickly to ensure that their current policies have been updated to reflect those changes.

Some of the requirements to note:

  1. Besides distributing the DFEH 185 brochure to all employees, regardless of company size, employers with 5 or more employees must have in place, in writing, a policy against harassment, discrimination and retaliation.
  2. Written policies must clearly state that unpaid interns, contractors and volunteers are covered under this redefined policy.
  3. Ensure that proper complaint and investigation procedures are in place.
  4. Translations must be provided for every language that is spoken when the workforce in any location contains 10% or more persons who speak a language other than English.
  5. Employers should distribute these new policies as amendments to their handbook policies and get acknowledgements as proof of distribution. This can be done electronically, via e-mail, company intranet, during new hire onboarding processes or meetings.

The new amendments have not addressed penalties for failure to maintain a compliant policy. However, employers need to be put on notice that if an employee brings forth a complaint, the failure of being compliant may be added on for further damages.

CALIFORNIA PREGNANCY DISABILITY LEAVE NOTICE CHANGES EFFECTIVE APRIL 1, 2016

Employers with five (5) or more employees and public entity employers of any size are required to post the revised California Pregnancy Disability Leave notice, or otherwise comply with the notice changes, beginning on April 1, 2016. Take care not to change the required notice prior to April 1, 2016. Changes for the posting can be obtained here with reference to DFEH-100-20 (04/16).

Instructions for posting:

  • If you received your 2016 labor law poster from PIASC, cross out the “Notice A” by putting an “X” over the entirety of this section, and write over this section, "SEE DFEH REVISED NOTICE EFFECTIVE 4/1/16".
  • Post the page of the new notice near the employment poster. If you purchased your employment posters from PIASC, a new laminated notice will be mailed out shortly.
  • Please be advised that there is no penalty if the posting is not updated by April 1, 2016.

TAKE THE TRIPLE-A APPROACH TO EXPECTATIONS

If employees don’t know what you expect of them, they won’t be able to meet your organization’s requirements. When they’re hired, and for as long as they work for you, help them focus on these three areas of performance:

  • Achievement. Spell out what results the employee is expected to achieve and what goals he or she should work toward.
  • Accountability. What is the employee ultimately responsible for? How will you measure their success?
  • Accessibility. Employees should be open to feedback and supportive of co-workers, the team, and your organization.
