Question:  

We have an employee requesting a leave of absence. What are the top things we should do as an employer? 

Answer: 

When an employee requests to go on leave: 

  • Employers must confirm what type of job protected leave the employee qualifies for. 
  • If the employee does not qualify for a job protected leave under state or federal, will this be accommodation? Accommodating will set precedence.  Employee may be protected under FEHA Fair Employment and Housing Act. 
  • The employee must provide a doctor’s note. 
  • Formal letter should be provided to employee to document leave. 
  • The employee must be inactive status/leave status on HRIS.
